PRIVACY AND INFORMATION DISCLOSURE OF INFORMATION

This Website will ask you to register and provide information about yourself and your properties. SellYourFloodHouse uses the information you provide to deliver to match your property with potential purchasers.  Our Website also provides you with an opportunity to update your registration and property listing information as needed.

The extent and type of information we receive from you on SellYourFloodHouse Websites depend on the information you provide to us through our contact mailboxes and/or through the registration processes on our sites.

The personal information you provide to us will be retained only for as long as necessary to fulfill the purposes for which the information was collected (listing of your property) or as required by law.  However, SellYourFloodHouse may share personal information with third parties as necessary to carry out our business or as required by law or other legal processes.  SellYourFloodHouse may sell personal information.  Personal data collected by SellYourFloodHouse may be transferred to related business entities of SellYourFloodHouse where it is necessary to meet the purpose for which you have submitted the information.  By submitting data through SellYourFloodHouse electronically, you are providing explicit consent to trans-border transmission of data collected via SellYourFloodHouse’s Website.

SellYourFloodHouse has technological and operational security policies and procedures in place to protect your personally identifiable information from loss, misuse, alteration or unintentional destruction.  Our personnel who have access to the data have been trained to maintain the confidentiality of such information.

SellYourFloodHouse only uses your personally identifiable information to respond to your requests and to provide information about SellYourFloodHouse’s real estate listing services.  If you send us a real estate listing information to list your property with SellYourFloodHouse, we will use the information provided to provide leads to potential interested purchasers and to provide information to interested third-party vendors who may contact you to provide you with their products or services.

In addition, “cookies” (i.e., small text files placed on your computer when you first visit a web site) are used on some of our Websites.  Most browsers now recognize when a cookie is offered and permit you to refuse or accept it. Cookies are primarily used to enhance your online experience and are not used to track the navigational habits of identified visitors, unless we obtain your permission to do so. If you visit our sites to read or download information, such as news stories or articles, much of the information we do collect is statistical only (e.g., the domain from which you access the Internet, the date and time you access our Website, and the Internet address of the Website from which you linked directly to our Website) and not personally identifiable. We use this information about the number of visitors and their use of the sites in aggregate form to make our Websites more useful and attractive to you.

As a matter of policy, the Company does not sell or rent any of personal information to third parties for their marketing purposes without explicit consent. However, the following describes some of the ways that personal information may be disclosed in the normal scope of business to provide our services.

Advertisers.

The Company may aggregate (gather up data across all user accounts) personal information and disclose such information in a non-personal identifiable manner to advertisers and other third parties for their marketing and promotional purposes.  Certain information, such as your name, email address, password, credit card number, and bank account number, are not disclosed to these third parties in a personally identifiable manner without your explicit consent.

Other Website Users.

Basic information about your property is displayed throughout the Website and is therefore available to the public.  It would be difficult, if not impossible, for a member of the public to identify your house or to uncover your personal contact information based on the information that is made available to the general public. However, in order: 1) to accomplish the purpose of the business; 2) to allow parties interested in buying real estate meeting certain specified criteria; and 3) to identify sellers, the Company must at some point disclose a seller's address and contact information to third parties who pay a fee to obtain such information. The requirement that parties pay a fee for such information should serve as a filter to only provide a seller's contact information to parties with an active interest in possibly purchasing the seller's property, since it is unlikely that a party would pay the fee to obtain such information unless he or she was interested in possibly acquiring the seller's property. However, the Company cannot assure you that a party paying for such information will not use it for another purpose, even though doing so will be in violation of this Agreement.


Internal Service Providers for Our Operations.

The Company may use third parties that the Company refers to as internal service providers to facilitate or out source one or more aspects of the business, product and service operations that the Company provides to you, and therefore the Company may provide some of your personal information directly to these internal service providers. These internal service providers' are subject to confidentiality agreements with us and other legal restrictions that prohibit their use of the information the Company provides them for any other purpose except to facilitate the specific out sourced Company related operation, unless you have explicitly agreed or given your prior permission to them for additional uses. In some instances, the internal service provider may collect information directly from you. In these cases, you will be notified of the involvement of the internal service provider, and all additional information you provide them and their additional uses will be strictly up to you. If you provide additional information to an internal service provider directly, then their use of your personal information is governed by their applicable privacy policy.

Legal Requests.

The Company cooperates with law enforcement inquiries, as well as other third parties to enforce laws, such as: intellectual property rights, fraud and other rights, to help protect you and the Company community from criminal or fraudulent activity. Therefore, in response to a verified request by law enforcement or other government officials relating to a criminal investigation or alleged illegal activity, the Company can, and you authorize this Company to, disclose your name, city, state, telephone number, email address, fraud complaints, and listing history without a subpoena. Without limiting the above, in an effort to respect your privacy and our ability to keep the community free from bad actors, the Company will not otherwise disclose your personal information to law enforcement or other government officials without a subpoena, court order or substantially similar legal procedure, except when the Company believes in good faith that the disclosure of information is necessary to: prevent imminent physical harm or financial loss; or report suspected illegal activity. Further, the Company can, and you authorize us to, disclose your name, street address, city, state, zip code, country, phone number, email, and company name as the Company, in its sole discretion, believes necessary or appropriate in connection with an investigation of fraud, intellectual property infringement, piracy, or other unlawful activity.

Regulatory Environment

Due to the existing regulatory environment, the Company cannot ensure that all of your private communications and other personal information will never be disclosed in ways not otherwise described in this Agreement. By way of example and without limiting the foregoing, the Company may be forced to disclose personal information to the government or third parties under certain circumstances, third parties may unlawfully intercept or access transmissions or private communications, or users may abuse or misuse your personal information that they collect from the Website. Therefore, although the Company uses industry standard practices to protect your privacy, the Company does not promise, and you should not expect, that your personal information or private communications will always remain private.


GENERAL PROVISIONS

  1. If any provision of these terms of use is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches. These terms of use may be amended or changed by us at our discretion. You agree that your continued use of this Website after such amendment or change shall signify your acceptance of any such change.
  2. Our services are available only to, and may only be used by individuals who can form legally binding contracts under applicable law. Without limiting the foregoing, our services are not available to children (persons under the age of 18) or to temporarily or indefinitely suspended users of the Website.
  3. The Company reserves the right to modify, change or discontinue our service or any feature at any time without notice.  Each user agrees that the Company is not liable to any user or to any third party as a result of any such action.
  4. Each user shall comply with all applicable domestic and international laws, statutes, ordinances and regulations regarding your use of our service and your offer to purchase, listing, purchase, solicitation of offers to purchase, and sale of items or property.  Each user agrees to indemnify and hold us and (as applicable) our parent, subsidiaries, affiliates, officers, directors, agents, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of this Agreement or the documents it incorporates by reference, or your violation of any law or the rights of a third party.
  5. If a user violates or exceeds the scope of this Agreement or infringes our proprietary rights, each user agrees that the Company would be irreparably harmed and may (in addition to other relief and without having to post a bond) obtain a court order enjoining the user from further misconduct.
  6. Each User agrees to indemnify and hold the Company harmless from all losses, liabilities, damages and costs, including reasonable attorneys' fees, arising out of or related to users’ breach of these terms of use.
  7. In the event that:
    1. a user breaches this Agreement or any other agreements applicable this user relationship;
    2. the Company is unable to verify or authenticate any information provided by a user for the Website; or
    3. the Company believes that your actions may cause financial loss or legal liability for the user, other users, or the Company,
      the Company may, without limiting other remedies, limit that user’s activity, immediately remove the user’s property listings, warn our other users of that user’s actions, issue a warning, temporarily suspend, indefinitely suspend or terminate the user’s membership or rights to use the Website and refuse to provide additional service to that user.
